Plaintiffs’ Lawyers Win $1B+ in Third DePuy Pinnacle Trial

DePuy hip lawsuitCongratulations to plaintiffs’ attorneys Jayne Conroy, Mark Lanier, and the entire team who secured a staggering $1 billion federal jury verdict in the third bellwether trial involving the Johnson & Johnson (J&J) DePuy Pinnacle metal-on-metal hip replacement devices.

After less than a day of deliberation, the jurors in the U.S. District Court for the Northern District of Texas Dallas Division found that J&J failed to warn about the defective design of the Pinnacle hips and their associated risks.

The plaintiffs’ lawyers convinced the jury that J&J “… sidestepped standard regulatory review and misled doctors to believe that the design of the market-leading DePuy Pinnacle device was safe,” according to a press release issued by Co-Counsel Conroy’s law firm, Simmons Hanly Conroy. The six patients, all of whom required revision surgery after their hip implants failed, were awarded $1.041 billion. That award includes $32 million in compensatory damages, and the rest in punitive damages.

Key evidence showed that J&J aggressively marketed the Pinnacle hip system despite knowing its serious risks – even by providing kickback payments to surgeons. The success rate for the Pinnacle implants was just 53 percent after 11 years, according to the plaintiffs.

“The evidence presented in the testimony against J&J told the deeper story of how the science was manipulated in order to sell the product,” Conroy said in the release.

This win is yet another example of how trial lawyers and our civil justice system continue to prevail against huge corporations who allow people to get hurt for the sake of a profit.
