Congratulations are in order for Jennie Lee Anderson and Lori Andrus of Andrus Anderson on a major win in a worker misclassification lawsuit filed against Moet Hennessey USA, Strategic Experiential Group, and related entities. Along with McCormack & Erlich, Andrus Anderson obtained a $1.95 million settlement on behalf of a class of models, logistics personnel, and brand ambassadors.
Strategic Experiential Group contracts with liquor brands including Moet Hennessy to provide brand ambassadors and personnel for public promotional events. The lawsuit alleged the companies violated California Labor Code and did not pay the plaintiffs for mandatory training and for showing up early at events. The companies also allegedly failed to reimburse the employees for uniform costs or missed breaks.
The plaintiffs sued their former employers in 2016, claiming they misclassified workers as independent contractors and failed to pay them fair wages. According to the settlement agreement, each class member will receive an average payout of about $1,580. While the money provides some recompense to those who were wronged, it also sends a message to companies that it’s unacceptable to withhold adequate pay from those who have earned it.
All of us at Milestone commend the legal teams at Andrus Anderson and McCormack & Erlich for standing up to several big companies that failed to provide employees with their rightful pay. By continuing to bring these injustices to light, our country gets one step closer to accepting fairness as commonplace across all industries.
Big litigation wins also raise the question of how to best streamline the complex settlement process.
